This website is owned and operated by State Rental Service. These Terms set forth the terms and conditions under which you may use our website and services as offered by us. This website offers visitors a rental service but limited to – This website is purely an information and reservation service. It does not provide the opportunity to enter into rental contracts. Rental contracts are exclusively entered into at branch locations of direct service providers and its affiliates and their respective franchisees. Addresses and contact details for branches are available on request. . By accessing or using the website of our service, you approve that you have read, understood, and agree to be bound by these Terms.

Scope; Services Provided by State Rental Service; Data Protection

1.1. This website is offered by State Rental Service for the benefit of its affiliates and their licensees/franchisees operating the subsidiary (State Rental Service) System throughout the world.

1.2. The services provided by on this website are, among others:

a) Providing the usability options of the site as per these Terms of Use;

b) Providing information about available vehicles, pick-up locations, rental tariffs and current special offers for car rental in the countries where State Rental Service and its affiliates or franchisees operate;

c) Allowing customers to complete reservation requests for the rental of vehicles; and

d) Allowing customers to complete prepaid bookings in some cases.

1.3. State Rental Service plans to maintain the website permanently. Nevertheless, users cannot derive from this an entitlement to future use of the website. Should State Rental Service plan to close the website, State Rental Service will inform the user in advance by displaying relevant information on the website.

1.4. State Rental Service reserves the right to change, expand, or reduce the content, structure and design of the website.

1.5. State Rental Service in no way guarantees the availability of the website, neither temporally nor geographically. State Rental Service may temporarily reduce the usability of the website, individual functions and the availability of the information if there are sufficient legal or technical reasons for this measure. Technical reasons in particular include, among others, maintenance work, updates to the underlying software, and maintaining the security or integrity of the website.

1.6. The gathering and use of personal data in conjunction with the use of the website is described in the Privacy Policy below.

2. Reservation Requests

2.1. This website is purely an information and reservation service. It does not provide the opportunity to enter into rental contracts. Rental contracts are exclusively entered into at branch locations of Direct Rental Service providers and its affiliates and their respective franchisees. Addresses and contact details for branches are available on demand.

2.2. The website may provide the user with two reservation service options: 1) where available, prepaid booking: a binding reservation subject to the Pay Now Terms and Conditions; or 2) non-binding reservation requests. Except in case of a prepaid booking, either party may cancel any reservation requests, whether or not the reservation request has been confirmed, for any or no reason, in its sole discretion, and without liability to the other party.

3. User Account

3.1. The user does not need to register in order to make use of the website, the available information, and reservation requests or prepaid bookings.

4. User’s Obligations and Consequences of Terms of Use Violations

4.1. The website and the underlying database may only be used in the manner intended by State Rental Service. In particular, the information may only be viewed via State Rental Service websites using an Internet browser.

4.2. It is not permitted to

a) send or make accessible any viruses or other malicious software;

b) take measures that could negatively impact or damage the process or functionality of the State Rental Service websites or other users’ computer systems;

c) circumvent or render ineffectual any functions (e.g. search forms) of the website or in any other way interfere with the State Rental Service website;

d) take measures that could result in overloading of the State Rental Service websites’ infrastructure;

e) block, overwrite or modify content generated by State Rental Service;

f) use automatic functions (e.g. algorithms, machines) to search for vehicles or acquire vehicle rental quotes;

g) gather or acquire by any other means, and store, information on other users without their consent, especially e-mail addresses; and

h) gain unauthorized access to the networks.

4.3. If there is a reasonable suspicion of violations against the Terms of Use, against the law, or against the rights of third parties, State Rental Service reserves the right to:

• issue a formal warning to the user;

• temporarily limit or block the user’s access to the website;

• permanently block and delete the user’s access.

5. Enterprise Intellectual Property

5.1. The content, structure and layout of this website, are owned by State Rental Service. All intellectual property rights (e.g. trademark and copyrights, database rights) are owned by State Rental Service.

5.2. Individual contents of the website, in particular rental car offers and reservation requests may only be downloaded, printed or copied for the user’s own non-commercial use.

5.3. Any use beyond this, especially editing, copying, disseminating or other public disclosure is not permitted without prior written consent from State Rental Service.

5.4. If you in believe that materials posted on the website violate your intellectual property rights, please contact State Rental Service by email or other forms. Please include: (1) an electronic or physical signature of the person authorized to act on behalf of the owner of the copyright or other proprietary interest; (2) a description of the copyrighted work or other protected material that you claim has been infringed upon; (3) a description of where the material is located on the website; (4) your address, telephone number and e-mail address; (5) your statement that you have a good faith belief that the disputed use is not authorized by the copyright or other interest owner, its agent or the law; and (6) your statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright or other interest owner or are authorized to act on the owner’s behalf.

5.5. State Rental Service affiliation and service provided are included in the family of trademarks and service marks owned by State Rental Service. Trademarks and service marks designated with the “®” symbol are registered with the Indian Patent and Trademark Office and with numerous foreign countries.

6. Limitation of Liability

6.1. The website provides links to websites of companies affiliated with the service provided and other third parties. State Rental Service does not assume liability for the information provided under those links or for the nature, safety, or legality of the services provided there.

6.2. State Rental Service does not assume liability for any advertisements and information provided by State Rental Service and third parties.

6.3. State Rental Service is liable for deliberate and grossly negligent acts.

6.4. State Rental Service is not liable for acts of simple negligence only in cases of harm to life, limb, or health, or in case of violations of material contractual obligations. In cases of violation of material contractual obligations, State Rental Service liability is limited to the anticipated damage typical for such contracts. A material contractual obligation is an obligation the fulfilment of which is a prerequisite for the achievement of the purpose intended by entering into the contract, and the fulfilment of which the user can regularly expect.

6.5. State Rental Service is not liable in cases of Force Majeure, especially not for non-fault disruptions within the cable network.

6.6. State Rental Service is only liable for the loss of data inasmuch as prescribed by the above sections 6.3 and 6.4 if the loss of data could not have been avoided by appropriate security measures on the user’s part.

6.7. The above limitations of liability also apply accordingly for State Rental Service legal representatives and agents.

7. Severability/Waive Clause

7.1. Should individual provisions of these Terms of Use be invalid or become invalid, this does not affect the validity of the remaining provisions. State Rental Service failure to enforce any provision of this Terms of Use does not constitute a waiver of that or any other provision.

8. Applicable Law

8.1. If you are accessing a website with a domain in your country of residence, the law of the country of your residence governs these Terms of Use. Otherwise, the laws of Indian govern these Terms of Use. The UN Convention on the International Sale of Goods is excluded.

WHAT INFORMATION WE COLLECT

Information Collected About You
You may provide us with certain information in connection with a transaction or in your interactions with our websites and at our locations. We collect the following types of personal information from you:

Your name, contact information, date of birth, driver’s license number and expiration date and emergency contact information;

Vehicle rental information, including the location of where the vehicle is rented, date of rental, type of rental and your preferences;

Your credit card details, online user account details, membership/corporate ID numbers, passport information and frequent flyer or travel partner affiliations

As a (“State Rental Service”), State Rental Service may share with us your reservation and booking information. For these transactions, we and State Rental Service are independent data controllers. We also share information about you with State Rental Service, as described below in the section titled “Who We Share Information With”.

Third parties provide us with additional information about you, including:

Referral sources, such as third party online booking sites (who provide us general contact information and a booking confirmation number to facilitate the rental), your employer (general contact information), and your insurance provider (general contact and policy information).

Where applicable, our Refer-A-Friend programmes.

Hotel, airline and membership clubs, who provide us your general contact information and booking information.

Credit reporting agencies, who, for fraud prevention purposes, provide us with identity-related information.

Service Providers, such as customer support (customer service-related information and enquiries made by you) and marketing providers (information to assist us to better communicate our products and services).

With your consent, we will access location-based information or collect location markers from your mobile device or based on your IP address. We will use this information to provide you with notifications related to our locations, return information, local offers or other information that we think will be helpful in providing you with better services. We do not use this information to specifically locate you for any reason other than to provide you the service. With your consent, our application will utilize your device’s camera. If you have allowed us to utilize your location information or your device’s camera in the past and wish to revoke the permissions, please change the settings on your device.

Vehicle Data
Our vehicles may be equipped with technology that collects and transmits data. (“Vehicle Data Systems”). This may include information collected from event data recorders, global positioning devices, OnStar systems, or any other similar technology. Some or all Vehicle Data Systems functionality will be active during rental periods. When installed and where permissible, Vehicle Data Systems will enable us to collect and use information such as (1) location information, (2) collision information, and (3) vehicle operation information, such as operational condition, mileage, tire pressure and fuel status and other diagnostic and performance information. Once collected, this information may be combined with information you have provided us and used to generate safety, performance, and other similar information so that we can deliver better services. Our use of information collected from the vehicle may include sharing information with their parties such as service providers, partners, and as otherwise explained in this privacy policy. Our use of the information may also include storage of this information after the expiration of the rental agreement. Your use of the Vehicle Data Systems made available to you is subject to the terms and conditions and privacy policy posted by the applicable Vehicle Data Systems provider and/or vehicle manufacturer (in the case of OnStar, information is available at www.onstar.com), which may include system and service limitations, warranty exclusions, limitations of liability, wireless service provider terms, privacy practices, descriptions of use and sharing of information and user responsibilities. We are not responsible for any data that is left in the vehicle as a result of your use. We cannot guarantee the privacy or confidentiality of such information and you must wipe it before you return the vehicle to relevant provider. Telematics Data will be shared with emergency service providers, others who assist in responding to an accident, telematics service operators or those with whom we have a legal or contractual obligation to provide such data.

HOW WE USE INFORMATION ABOUT YOU
We use the information we collect from you or about you to provide you with our services and for the following purposes:

Where it is necessary for us to enter into a contract with you and provide services to you for the duration of the contract, including

To assist the transactions that you request, such as reserving, renting, purchasing or leasing motor vehicles.

To provide customer service related to your interactions with us or to respond to your enquiry.

To enrol you in our loyalty programmes and send non-promotional information relating to your ongoing membership of these programmes.

Where necessary for us to comply with a legal obligation, including

To share information about your vehicle’s location with emergency services in the event that you are involved in a road accident.

To share information with government and regulatory authorities when required by law or in response to legal process, obligation, or request.

Where it is necessary for our legitimate interests, as listed below, and where our interests are not overridden by your data protection rights, including

To communicate important information about your rental, such as arrival and return alerts.

To assist us in providing better products and services: for example, to evaluate the performance of our staff, to assess the quality of products and services received and to help us improve our websites, facilities and services.

To compile statistics and analysis about our customers’ use of our websites, products and services.

To develop a profile of you and your interactions with us so that we can provide tailored offers, opportunities and services that may be of interest to you.

To protect our legal rights and manage the security of our networks and property. For example, we will use CCTV to ensure the security of our premises and we maintain Do Not Rent lists of customers that are non-payment or safety risks.

To share your information with third parties in order to prevent fraud and protect our business interests and rights, privacy, safety and property, or that of the public. We will do this to collect unpaid bills, to avoid liability for penalties you incur (e.g. traffic citations) and for claims processing purposes.

To share your information with third parties in order to permit us to pursue available remedies or limit damage that we may sustain and to enforce the terms of any rental agreement or our websites’ terms and conditions. To share your information with third parties in order to prevent fraud and protect our business interests and rights, privacy, safety and property or that of the public. We will do this to collect unpaid bills, to avoid liability for penalties you incur (e.g. fixed penalty notices for driving offences) and for claims processing purposes. To share your information with third parties in order to permit us to pursue available remedies or limit damage that we may sustain and to enforce the terms of any rental agreement or our websites’ terms and conditions. We will also disclose your information to third parties if the rights of another individual may be violated.

To send you text messages in order to provide you with time sensitive communications related to your transaction (e.g., construction delay at airport branch), extended rental opportunities, customer experience surveys, marketing promotions such as coupons, discounts, last-minute specials or loyalty and rewards information.

Retention of Your Personal Information
We retain your personal information for as long as we need to fulfil our business purposes, as set out below:

Marketing purposes: We keep data linked to cookies and other online identifiers for up to three years. We keep other marketing information, such as email subscription and loyalty enrolment data for up to 7 years after your last interaction with us.

Rental transactions: We keep the data associated with your rental agreement for up to 7 years from the date of the rental, subject to other local legal requirements. We keep records of payments you have made for 2 years from the date of the transaction (depending on the location of the rental).

Customer service related queries: We keep general queries for 3 years, unless you make a complaint, in which case, we keep complaints data for 7 years.

Disputes & law enforcement: If we are involved in litigation or a governmental or regulatory investigation, then we keep data throughout the period of litigation or investigation and for 5 years after that. If a settlement means that we have to keep data for longer, then we keep data for the period required to administer the settlement. If we provide data to law enforcement agencies, then we keep a record of this for one year beyond the end of the investigation.

SOCIAL MEDIA WIDGETS 
Our websites may include social media features, such as the Facebook button. These features may collect your IP address, pages you are visiting on our site, and may set a cookie to enable the feature to function properly. Social media features and widgets are either hosted by a third party or hosted directly on our site. Your interactions with these features are governed by the privacy policy of the company providing it. 

If you use one of these social media sites and do not want them to collect data through our website and link it to your member data, you must log out of your user account before visiting our website and delete the relevant cookies. WHO WE SHARE INFORMATION WITH
Affiliates

We share the information we collect about you with our affiliates (“Affiliates”) for the purpose of providing the transactions you have requested and (with your consent) for marketing purposes.

State Rental Service

We share your personal information with State Rental Service for the following purposes:

To manage your rental and for State Rental Service to communicate with you about or assist with your rental.

In relation to any incident arising from your dealings or an additional authorized driver’s dealings with State Rental Service if State Rental Service thinks that, as a result of such incident, you or an additional authorized driver could be a risk for future rentals.

In order for State Rental Service and its third-party service provider to carry out phone customer satisfaction surveys.

To send you marketing communications about similar products or services which State Rental Service thinks may be of interest to you, including targeted advertising on State Rental Service sites, selected partner sites and social networks.

To compile statistics and analysis about you – and any applicable additional authorized drivers’ – use of State Rental Service products and services, including statistics based on anonymized data, which enable State Rental Service to provide you and other customers in the future with better customer service, products, features and functionalities.
When sharing such information with State Rental Service, we State Rental Service operate as independent data controllers. State Rental Service maintains its own privacy policy in respect of the information we provide State Rental Service.

Our Service Providers and Business Partners

We will share your information with third parties, such as (1) payment, administrative and technical support providers, (2) our insurance, corporate rental or other customers or partners to facilitate the rental transaction, (3) communication providers which send email and other marketing and service-related communications to you on our behalf, (4) customer support providers in order to provide you customer service, (5) debt collection providers, (6) claims processors, and (7) our advertising and marketing partners and third-party media properties, including social media sites, with whom we share aggregated or de-identified information about our customers, to allow them to send targeted advertising messages on our behalf, to analyze, enhance and manage our data, conduct mobile analytics services and to maintain and improve our services (subject to confidentiality agreements as appropriate).

GLOBAL DATA TRANSFERS AND PROCESSING
The information you provide us or that we collect may be transferred or accessed by entities around the world, including:

State Rental Service: If you book a reservation with us or with an Direct service provider’s owned location, we will transfer your personal information to State Rental Service. State Rental Service is based in India and has affiliate/Third Party locations in the United States and Canada.

Third Party Service Providers: We utilise third party service providers who are located outside the countries where we have corporate-owned locations, such as call centre support, claims processors and IT providers.

YOUR RIGHTS
Your rights may include the right to: 1) ask us for a copy of your personal information, 2) request that we correct your personal information, 3) request that we erase certain categories or types of information, 4) request that we restrict certain processing, 5) obtain the information you provide in a structured, machine readable format and 6) to transfer some of this information to other organizations. You have the right to object to processing of personal information on the basis of our legitimate interests. Where we have asked for your consent to process information, you have the right to withdraw this consent at any time.
